Welcome to Worksheet Builder. These Terms of Service ("Terms") are a binding agreement between you and Worksheet Builder ("Worksheet Builder", "we", "us", or "our"), operated by [Company Legal Name]. 1. Acceptance of these Terms
By creating an account, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
- If you use the Service on behalf of a School, employer, or other organization, you represent that you are authorized to accept these Terms on its behalf, and "you" includes that organization.
- If you do not have such authority, or if you do not agree with these Terms, you must not use the Service.
- We may update these Terms from time to time as described in the "Changes to these Terms" section below. Your continued use of the Service after an update means you accept the revised Terms.
Separate agreements take precedence. If you or your School have entered into a separate written agreement or data protection addendum with us (for example, a school or district agreement or a data processing addendum), that agreement controls to the extent it conflicts with these Terms for the matters it covers.
2. Who may use Worksheet Builder
The Service is intended for teachers, Schools and districts, students (under School authorization), parents, and general visitors. Eligibility depends on your role.
Age and general eligibility
- You must be able to form a legally binding contract to create an account and use the Service on your own behalf. In most cases this means you must be at least 18 years old, or the age of majority in your jurisdiction.
- The Service is not directed to children under 13 for independent sign-up. Children may use the Service only through a School or other authorized adult, as described below.
- General visitors may browse our public marketing pages and may choose to provide information (for example, to receive a newsletter) subject to these Terms and our Privacy Policy.
Teachers and educators
- Teachers and other educators may use the Service to create, manage, and use worksheets and educational resources, including AI Features (defined below).
- You are responsible for using the Service in a manner consistent with your School's policies and with applicable laws.
Schools and districts
- A School may authorize teachers, staff, and students to use the Service under the School's account or arrangement.
- Where a School directs the use of the Service for its students, the School is responsible for providing appropriate notices and obtaining any consents required by applicable law.
- The Service is designed to align with student-privacy laws that apply to educational providers (such as FERPA and COPPA) and to support Schools in meeting their own obligations. When we handle student personal information at a School's direction, we intend to act as a "school official" or "service provider" under those laws, as further described in our Privacy Policy.
Students under School authorization
- Students may use the Service only when authorized by their School and, where required, with appropriate parental or guardian consent obtained or facilitated by the School.
- Student use is limited to educational purposes directed by the School. Student data is processed under the School's instructions and is governed by our Privacy Policy. As described in the "Your content" section below, student and education data is not used for targeted advertising, is not used to build non-educational profiles, and is not used to train third-party AI models for unrelated purposes.
- If a teacher or other account holder uses the Service with children under 13 without a School providing the required notice and consent, that account holder is responsible for obtaining verifiable parental consent as required by COPPA before those children use the Service. If such consent is not obtained, that use is not permitted.
Parents
- Parents and guardians may interact with the Service to the extent permitted by the relevant School and applicable law. Questions about a child's data should generally be directed to the child's School, which controls that data; you may also contact us at [Privacy Contact Email].
3. Your account and your responsibilities
To use most features, you must create an account and provide accurate information such as your name, email, and other account details.
- Keep your account information accurate and up to date.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

- You may not share your account, transfer it to another person, or allow others to use it except as expressly permitted by your School or by us.
- You are responsible for the devices, networks, and connections you use to access the Service.

4. Acceptable use and prohibited conduct
You agree to use the Service lawfully, professionally, and in a way that respects the educational community it serves. You agree not to:
- Use the Service in violation of any applicable law, regulation, or School policy.
- Upload, create, or share Content that is unlawful, infringing, defamatory, harassing, hateful, obscene, or otherwise harmful, or that is inappropriate for an educational setting.
- Infringe or misappropriate the intellectual property, privacy, or other rights of any person.
- Upload student or other personal information without the authority and consents required by applicable law and your School's policies.
- Attempt to gain unauthorized access to the Service, other users' accounts, or our systems or networks.
- Interfere with, disrupt, overload, or impair the Service, or attempt to circumvent any security or access controls.
- Reverse engineer, decompile, scrape, or use automated means to access the Service except as expressly permitted.
- Use the Service to develop a competing product or service.
- Misuse AI Features — for example, to generate content that is unlawful, harmful, or that violates a third-party AI provider's terms.
- Misrepresent your identity, your affiliation, or your authority to act for a School.
We may investigate suspected violations and take appropriate action, including removing Content or suspending or terminating access, as described in the "Suspension and termination" section below.
5. Your content — ownership and the limited license you grant us
You and your School own your Content
- As between you and Worksheet Builder, you (or your School, as applicable) retain all ownership rights in the Content you create, upload, or save through the Service.
- We do not claim ownership of your Content, and we do not sell your Content.
- Where Content is created or provided under a School's account or direction, ownership and control of that Content, including student data, are determined by your arrangement with the School and the School's instructions.
The limited license you grant us
To operate the Service, you grant Worksheet Builder a limited, non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, modify (for formatting and display), and display your Content solely for the following purposes:
- To provide, maintain, secure, and support the Service for you and your School.
- To improve and develop the Service, consistent with our Privacy Policy and the limitations below.
- To enable features you use, such as saving, downloading, and sharing Content.
Any Content we use to improve or develop the Service is de-identified and/or aggregated wherever feasible. We do not use student or education data to train third-party AI models for unrelated purposes. This license exists only to run the Service and ends when your Content is deleted or your account is closed, except for copies retained as required by law or as described in our Privacy Policy (for example, routine backups for a limited period).
Student and education data
Student and education data is governed by our Privacy Policy and the School's instructions. In particular, student and education data is:
- Not used for targeted advertising.
- Not used to build profiles for non-educational purposes.
- Not used to train third-party AI models for unrelated purposes.
You are responsible for ensuring you have the rights and permissions needed for the Content you provide.
6. AI-assisted features and AI-generated content
The Service includes AI-assisted features that can help generate, draft, or modify worksheets and educational resources ("AI Features"). The text, images, or other materials produced by AI Features are referred to as "Outputs", and the prompts, instructions, and materials you provide are "Inputs".
How AI Features work
- AI Features rely on third-party AI tools and providers to process your Inputs and generate Outputs. Availability and behavior of these features depend on those providers and may change.
- Third-party AI providers operate under their own terms and privacy practices, which may change. We are not responsible for those providers' acts or omissions, and your use of AI Features is also subject to the applicable provider's terms where they apply to you.
- We do not use student or education data to train third-party AI models for unrelated purposes, consistent with our Privacy Policy.
Accuracy and your responsibility
- Outputs may be inaccurate, incomplete, biased, or otherwise unsuitable. AI Features can produce errors or content that is not appropriate for a given grade level or subject.
- A qualified educator must review Outputs before classroom or instructional use. You are responsible for verifying accuracy, appropriateness, and compliance with your curriculum and policies.
- We do not guarantee the accuracy of Outputs, and Outputs are not professional, legal, medical, or other expert advice.
Ownership of Inputs and Outputs
- As between you and Worksheet Builder, we claim no ownership of your Inputs or the worksheets you create using AI Features, and you retain whatever rights are available in them under applicable law, subject to applicable third-party AI provider terms and to the rights of any underlying content owners.
- We make no representation or warranty that Outputs are original, non-infringing, or protectable by copyright or other intellectual property rights. Under current law, purely AI-generated material may not be eligible for copyright protection.
- Because of how AI works, similar or identical Outputs may be generated for other users, and you do not receive exclusive rights in Outputs that are not unique to you.
- You are responsible for ensuring your Inputs and your use of Outputs comply with these Terms, applicable law, and any applicable third-party AI provider terms.
7. Our intellectual property and trademarks
The Service, including its software, design, text, graphics, logos, and other materials we provide (excluding your Content), is owned by Worksheet Builder or its licensors and is protected by intellectual property and other laws.
- We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for its intended educational purposes, subject to these Terms.
- "Worksheet Builder", our logos, and other brand features are our trademarks. You may not use them without our prior written permission, except to fairly refer to the Service.
- All rights not expressly granted to you are reserved by us and our licensors.
Your feedback
If you choose to send us suggestions, ideas, or other feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that feedback for any purpose without obligation or compensation to you. Feedback is voluntary, and "feedback" does not include your Content, Inputs, or any student data; sharing a worksheet or other Content with us does not place it under this feedback license.
8. Plans, payments, subscriptions, and refunds
Free during the beta
- Worksheet Builder is currently offered as a free private beta. No fees are charged for use of the Service during the beta, and because the beta is free, no refunds apply at this time.
- Beta features are provided "as is", may be limited, and may change or be discontinued at any time, as described in the "Service availability, beta status, and changes" section below.
Future paid plans
We may introduce paid plans, subscriptions, or other charges in the future. If and when we do:
- Pricing, features, billing cycles, applicable taxes, and payment terms will be presented to you at signup for the relevant plan, together with [Billing Terms].
- Refunds, if any, will be governed by [Refund Policy] and the pricing and terms presented at signup.
- We use third-party payment providers to process payments, and your payment information is handled as described in our Privacy Policy. You are responsible for providing accurate billing information and for charges incurred under your account.

- We are not liable for any modification, suspension, or discontinuation of the Service, except as required by applicable law. Where reasonable, we will try to provide notice of material changes.
10. Suspension and termination
Your right to stop using the Service

Our right to suspend or terminate
We may suspend or terminate your access to all or part of the Service, with or without notice, if:

Effect of termination
- On termination, your right to use the Service ends, and we may deactivate your account.
- We will handle your Content and any student data after termination as described in our Privacy Policy and any applicable School arrangement, including providing a reasonable opportunity to export or request deletion of Content where feasible.
- If the beta ends or you choose not to move to a future paid plan, we will, where feasible, give you a reasonable opportunity to export your Content before your access changes or your account is closed.
- Sections that by their nature should survive termination (including ownership, feedback, disclaimers, limitation of liability, indemnification, and governing law) will continue to apply.
11. Disclaimers
- The Service, including all features and Outputs, is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory.
- To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.
- We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that Outputs will be accurate, reliable, or suitable for any particular educational purpose.
- We use industry-standard safeguards, but no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
- You are responsible for reviewing AI Outputs and for your decisions about using the Service in your classroom or institution.
Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
12. Limitation of liability
To the fullest extent permitted by applicable law:
- Worksheet Builder, [Company Legal Name], and our affiliates, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or educational outcomes, arising out of or related to your use of (or inability to use) the Service or any Outputs.
- Our total aggregate liability arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us, if any, for the Service in the twelve (12) months before the event giving rise to the claim, or (b) [Liability Cap Amount]. - These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages.

- Your Content or Inputs, including any claim that they infringe or violate the rights of a third party.

- Your violation of these Terms or applicable law.
- Your failure to obtain any consents or authorizations required for student or other personal data you provide.
This indemnification obligation applies only to the extent permitted by applicable law and does not apply to any public institution or government entity (including public Schools and their employees acting in their official capacity) to the extent such an indemnity is prohibited or limited by law.
14. Governing law and dispute resolution
